App Terms, Privacy & Liability Policy

1. Introduction

This policy governs the use of the Multiflex Facility Services mobile and web-based application (“the App”).
By accessing or using the App, you acknowledge and agree to be bound by the terms outlined below.

All users of the App are engaged as independent contractors, unless otherwise agreed in writing.

2. App Purpose

The App is used to manage contractor attendance, job verification, communication, and record keeping. It is the official contractor management system of Multiflex Facility Services.

3. Contractor App Usage Requirements

​

All contractors must use the App for every job and every site visit, including:

• ⏱️ Clocking in and clocking out at each site

• 📸 Uploading clear before-and-after photos of completed work

• 📝 Reviewing and following site scopes of work and instructions

• 💬 Using the App for all work-related communication

Correct use of the App is mandatory and forms part of contractor obligations.

Failure to comply may result in operational follow-ups or contract review.

4. Information We Collect

​

The App may collect and store the following information:

• Name, contact details, and contractor details

• Time and attendance records

• Location data at the time of clock-in/out

• Photos uploaded for work verification

• Messages and communications within the App

• Device and usage data related to app functionality

5. Purpose of Collection

​

Information is collected for legitimate business purposes, including:

• Verifying attendance and work completion

• Managing service delivery and quality assurance

• Communicating instructions and updates

• Meeting legal, contractual, and compliance requirements

6. Location Services

​

Location data is collected only during work-related actions, such as clock-in and clock-out.
The App does not actively track users outside working activities.

7. Disclosure of Information

​

Personal information is not sold or traded. It may be disclosed only where necessary to:

• Operate the App and deliver services

• Meet legal or regulatory obligations

• Address insurance, audit, or dispute matters

All third parties are required to maintain appropriate confidentiality standards.

8. Data Security & Retention

​

Reasonable steps are taken to protect data from misuse, loss, or unauthorised access.
Information is retained only for as long as required for operational, legal, or contractual purposes.

9. Contractor Responsibility

​

Contractors are responsible for:

• Ensuring accurate and timely App usage

• Maintaining secure login credentials

• Reporting technical issues immediately

Multiflex Facility Services is not responsible for errors caused by user action, device issues, or connectivity problems.

10. Liability Disclaimer

​

To the maximum extent permitted by law:

• The App is provided “as is” without warranties of uninterrupted or error-free operation

• Multiflex Facility Services is not liable for losses arising from App downtime, GPS inaccuracies, internet failure, or third-party software issues

• Contractors use the App at their own risk

The App does not replace contractor obligations to work safely, competently, or lawfully. Multiflex Facility Services accepts no liability for injuries, incidents, or losses arising from contractor actions or omissions.

Where liability cannot be excluded by law, liability is limited to the resupply of the relevant service or the cost of resupply.

11. Indemnity

Contractors agree to indemnify and hold harmless Multiflex Facility Services against any claims, damages, losses, or expenses arising from misuse of the App, breach of obligations, or failure to follow instructions.

12. Changes to This Policy

​

This policy may be updated at any time. Continued use of the App constitutes acceptance of the updated terms.

13. Governing Law

​

This policy is governed by the laws of Victoria, Australia, and subject to its jurisdiction.

14. Acceptance

​

By using the App, you confirm that you have read, understood, and agreed to this policy.
